By downloading, installing, or using Is It Clean? ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

AGE REQUIREMENT: You must be at least 13 years old to use this App. By using the App, you represent and warrant that you are at least 13 years of age.

2. Description of Service

Is It Clean? is a mobile application that uses artificial intelligence to analyze photos of rooms and provide assessments of cleanliness levels.

IMPORTANT DISCLAIMERS:

• This app is for ENTERTAINMENT PURPOSES ONLY
• Cleanliness assessments are AI-generated OPINIONS, not facts
• Results should NOT be used for legal, rental, health, or safety decisions
• The app is provided as-is without any guarantees

3. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not upload inappropriate, offensive, or illegal content
• Not attempt to reverse engineer or hack the App
• Not use the App to photograph private spaces without permission
• Respect others' privacy when using the App

4. Intellectual Property

All content, features, and functionality of the App are owned by Is It Clean? and are protected by international copyright, trademark, and other intellectual property laws.

Photos you take remain your property. By using the App, you grant us a temporary, non-exclusive license to process your photos solely for providing the cleanliness assessment service.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND.

WE EXPLICITLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of cleanliness assessments
• The App will be uninterrupted, secure, or error-free
• Results will meet your requirements or expectations
• Any health or safety assessments

The cleanliness assessments are AI-generated entertainment content and should NEVER be relied upon for any important decisions.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

IN NO EVENT SHALL WE BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Personal injury or property damage related to your use of the App
• Any disputes, conflicts, or damages arising from cleanliness assessments
• Unauthorized access to or alteration of your transmissions or data

OUR TOTAL LIABILITY SHALL NOT EXCEED $1.00 USD.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

7. Indemnification

You agree to defend, indemnify, and hold harmless Is It Clean?, its creators, and any related parties from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including attorney's fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third party rights, including privacy rights
• Any claim that your use caused damage to a third party
• Photos taken without proper permission

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Modifications to Service

We reserve the right to modify or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

10. Changes to Terms

We may revise these Terms at any time. By continuing to use the App after changes are posted, you agree to be bound by the revised Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Arbitration Agreement

PLEASE READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS:

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be settled by binding arbitration in San Francisco, California, except that each party retains the right to seek injunctive or other equitable relief.

CLASS ACTION WAIVER: You agree that any arbitration shall be conducted in your individual capacity only and not as a class action or other representative action. You expressly waive your right to file a class action or seek relief on a class basis.

If any provision of this arbitration agreement is found to be invalid, the parties agree that the invalidity of that provision shall not affect the other provisions of this arbitration agreement.

14. Severability

If any provision of these Terms is held to be illegal, invalid, or unenforceable, the remaining provisions shall continue in full force and effect.

15. No Professional Advice

The App does not provide professional cleaning, health, safety, or legal advice. Always consult appropriate professionals for important decisions.
